These Terms of Service (“Terms”) govern your use of https://sfloridacharters.com/ and the yacht charter services provided by Sflorida Charters (“Company,” “we,” “us,” or “our”).

By using our website, requesting a reservation, making a reservation, or participating in a yacht charter arranged through us, you agree to these Terms.

If you do not agree with these Terms, please do not use our website or services.

1. Yacht Charter Services

Sflorida Charters provides private yacht charter experiences departing from Miami, Florida.

Available yachts, charter durations, pricing, capacity, and amenities may vary by vessel.

Charter options may range from approximately 2 to 6 hours, depending on the yacht selected and availability.

Our available yachts may include:

  • Quest – 40′ Yacht

  • Jems – 50′ Yacht

  • Stocks And Blondes – 55′ Yacht

  • Markets Closed – 50′ Yacht

  • My Distraction – 60′ Yacht

  • Viral Pink – 50′ Yacht

  • Bettsy – 60′ Yacht

 

Availability and specific vessel assignments are subject to confirmation.

2. Reservations

A reservation is not considered confirmed until the Company has received the required booking information and payment or deposit, as applicable, and confirmation has been provided.

Customers are responsible for providing accurate information when making a reservation, including:

  • Name.

  • Contact information.

  • Number of guests.

  • Charter date.

  • Charter time.

  • Any other information required to complete the reservation.

The customer is responsible for reviewing the reservation details and notifying us promptly of any errors.

3. Capacity and Guests

Each yacht has a maximum permitted passenger capacity.

Customers must not exceed the maximum passenger capacity established for the selected vessel.

The Company and/or captain may refuse boarding or require guests to leave the vessel if passenger limits are exceeded or if a guest’s conduct creates a safety concern.

4. Captain Requirement

A licensed captain is required for all applicable yacht charters.

The captain fee is $75 per hour and is paid separately at the dock unless otherwise stated in the reservation.

The captain has authority over the operation and safety of the vessel.

Guests must follow all reasonable instructions provided by the captain or crew.

5. Charter Duration and Departure

Charter duration is based on the time purchased and confirmed at booking.

Guests are responsible for arriving at the designated departure location on time.

The exact departure address may be provided approximately 24 hours before the reservation.

Late arrival by the customer does not automatically extend the charter period.

If a customer arrives late, the captain or Company may be unable to extend the scheduled charter due to marina, operational, or subsequent booking requirements.

6. Pricing

Prices may vary depending on:

  • Yacht.

  • Date.

  • Day of the week.

  • Charter duration.

  • Availability.

  • Special events or holidays.

  • Additional services or fees.

Advertised prices may represent starting prices and may not include captain fees, gratuity, or other applicable charges.

The applicable price and charges will be presented during the booking process or communicated before confirmation.

7. Gratuity

Gratuity is not included unless expressly stated otherwise.

A gratuity of approximately 15%–20% is recommended for the captain and/or crew based on the quality of service.

8. Alcohol and BYOB

BYOB may be permitted on certain vessels, subject to the specific yacht’s rules and applicable laws.

Guests are responsible for consuming alcohol responsibly.

The captain may restrict or prohibit alcohol consumption when necessary for safety or compliance with applicable laws.

Illegal drugs are strictly prohibited.

9. Guest Conduct

Guests must behave responsibly and comply with applicable laws, marina rules, vessel rules, and captain instructions.

The following may result in termination of the charter without refund:

  • Dangerous or reckless behavior.

  • Fighting or threatening behavior.

  • Excessive intoxication.

  • Illegal drug use.

  • Intentional damage to the yacht.

  • Refusal to follow reasonable safety instructions.

  • Exceeding passenger capacity.

  • Any behavior that creates a safety risk.

The Company reserves the right to terminate a charter when reasonably necessary to protect guests, crew, the vessel, or property.

10. Damage to Property

Customers may be financially responsible for damage caused by themselves or members of their party through intentional, negligent, reckless, or unauthorized conduct.

This may include damage to:

  • The vessel.

  • Furniture.

  • Equipment.

  • Marine equipment.

  • Decorations.

  • Other property belonging to the Company or vessel owner.

11. Weather Conditions

Safety is our highest priority.

Charters may be affected by severe or unsafe weather conditions, including storms, strong winds, heavy rain, severe thunderstorms, or other conditions that the captain or Company determines may make the charter unsafe.

When unsafe weather conditions prevent the charter from operating safely, the reservation may be placed on hold and the customer may receive credit toward a future charter date.

Weather-related credit may be used for up to one year from the original reservation date.

Cloudy weather or light rain alone does not automatically qualify as unsafe weather and does not necessarily entitle the customer to a refund or rescheduling.

The captain and/or Company will make the final operational safety determination.

12. Cancellation and Refunds

Cancellation and rescheduling are governed by our Refund & Cancellation Policy, which is incorporated into these Terms by reference.

Generally:

  • Cancellations made 30 or more days before the scheduled charter are eligible for a full refund.

  • Cancellations made less than 30 days before the scheduled charter are subject to the full charter price.

  • Rescheduling requests should be submitted at least 14 days before the scheduled charter.

  • A $100 rescheduling fee applies when a rescheduling request is made between 14 and 20 days before the reservation and the new reservation date falls on Friday, Saturday, or Sunday.

13. No Guarantee of Specific Vessel

Although we make reasonable efforts to provide the yacht selected during the booking process, operational, maintenance, safety, or other circumstances may occasionally require a vessel change.

If a vessel must be changed, the Company will make reasonable efforts to provide a comparable alternative where possible.

14. Assumption of Risk

Yacht and boating activities involve inherent risks, including but not limited to:

  • Movement of the vessel.

  • Slippery surfaces.

  • Boarding and exiting the vessel.

  • Water-related activities.

  • Weather conditions.

  • Marine traffic.

  • Equipment use.

  • Accidental injury.

Guests voluntarily participate in the charter and acknowledge the inherent risks associated with boating activities.

15. Limitation of Liability

To the maximum extent permitted by applicable law, [Company Name] shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from the use of our services.

At Sflorida Charters, we understand that plans can change. This Refund & Cancellation Policy explains the cancellation, refund, rescheduling, and weather procedures applicable to our private yacht charter reservations in Miami, Florida.

1. Cancellation 30 or More Days Before the Charter

If you cancel your reservation 30 or more days before the scheduled charter date, you are eligible for a full refund of the charter amount paid, subject to any non-refundable third-party charges that were clearly disclosed at the time of booking, if applicable.

Refunds will generally be issued to the original payment method.

2. Cancellation Less Than 30 Days Before the Charter

If you cancel your reservation less than 30 days before the scheduled charter date, the full price of the charter booked will be charged and the reservation is non-refundable.

This policy applies regardless of the reason for cancellation, except where a specific exception is provided under this policy or required by applicable law.

3. Rescheduling

Customers who need to change their reservation date should contact us as soon as possible.

Rescheduling requests should be submitted at least 14 days before the scheduled charter.

When a rescheduling request is made between 14 and 20 days before the reservation and the new reservation date falls on Friday, Saturday, or Sunday, a $100 rescheduling fee will apply.

Rescheduling is subject to:

  • Yacht availability.

  • The requested new date and time.

  • Applicable pricing differences.

  • Any required rescheduling fee.

A reservation may not be rescheduled after the applicable cancellation deadline unless the Company agrees otherwise in writing.

4. Weather and Unsafe Conditions

Safety is our highest priority.

If the captain or Company determines that weather conditions are unsafe for the scheduled charter, the reservation may be placed on hold.

Unsafe conditions may include:

  • Severe storms.

  • Strong winds.

  • Heavy rain.

  • Severe thunderstorms.

  • Other dangerous weather conditions that may affect the safe operation of the vessel.

When a charter cannot safely operate due to unsafe weather, the customer may use the reservation amount as a credit toward a future charter date.

Weather-related credit is valid for up to one year from the original reservation date.

5. Cloudy Weather and Light Rain

Cloudy skies, overcast conditions, or light rain do not automatically qualify as unsafe weather conditions.

These conditions do not automatically entitle the customer to a refund, cancellation, or rescheduling.

The captain and/or Company will determine whether weather conditions make the charter unsafe.

6. Weather Determination

The decision regarding whether a charter can safely operate will be based on actual conditions and operational safety considerations.

Customers should not assume that a forecast of rain or clouds automatically means a charter will be canceled.

If the charter is determined to be unsafe, the Company will communicate the available options to the customer.

7. Late Arrival

Customers are responsible for arriving at the designated departure location on time.

Late arrival does not automatically extend the charter period.

If the customer arrives late, the charter may still end at the originally scheduled time.

Failure to arrive on time does not automatically qualify for a refund.

8. No-Show

If a customer fails to appear for the scheduled charter without prior notice, the reservation will generally be treated as a cancellation made less than 30 days before the charter.

The charter amount will therefore be non-refundable.

9. Company or Vessel Cancellation

In circumstances where the Company must cancel a charter due to circumstances within its control, the Company will make reasonable efforts to provide an appropriate alternative or rescheduling option.

If the charter cannot be provided and no suitable alternative is accepted or available, the Company may issue a refund as appropriate.

10. Safety-Related Cancellations

The captain has the authority to cancel, delay, shorten, or modify a charter when necessary for safety.

This may include circumstances involving:

  • Severe weather.

  • Mechanical issues.

  • Vessel safety.

  • Marina restrictions.

  • Government or regulatory restrictions.

  • Other conditions affecting safe operation.

Where a cancellation is caused by unsafe weather, the weather provisions of this policy will apply.

11. Refund Processing

Approved refunds will generally be returned to the original payment method.

Although we process approved refunds as promptly as reasonably possible, the time required for funds to appear in your account may depend on your bank, credit card company, or payment processor.

12. Promotional Offers
